
COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS (FONSI/RROF) This Notice is published pursuant to Federal Regulations promulgated by the United States Department of Housing and Urban Development (HUD) Environmental Assessment set forth at 24 CFR Part 58, Section 58.36. March 5, 2020 City of Pittsburgh-Office of Management and Budget 200 Ross Street, 2nd Floor Pittsburgh, PA 15219 412-255-2211 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Housing Authority of the City of Pittsburgh (HACP), the Urban Redevelopment Authority of Pittsburgh (URA), and the City of Pittsburgh (City) under HUD's Choice Neighborhoods Implementation Program. HACP has selected its instrumentality, Allies & Ross Management and Development Corporation (ARMDC), as its developer and competitively procured McCormack Baron Salazar, Inc. (MBS) to serve as the co-developer to implement this Choice Neighborhoods project. REQUEST FOR RELEASE OF FUNDS On or about March 21, 2020, the City will authorize HACP, URA, and the City to submit a request to HUD for the release of the following federal funds to undertake the project known as Larimer/East Liberty Phase IV: (a) Choice Neighborhoods Initiative Grant Funds pursuant to Section 24 of the United States Housing Act of 1937 (1937 Act), as amended by the Consolidated and Further Continuing Appropriations Act of 2013 and Consolidated Appropriations Act of 2014 (approximately $4,329,264); (b) 2018 and 2019 Community Development Block Grant (CDBG) funds (approximately $1,000,000 2018 and $986,512 - 2019); (c) HACP Moving to Work (MTW) Funds under the 1937 Act as modified by the 1996 and 1999 Consolidated Appropriations Act (approximately $2,804,610); (d) HACP Program Income funds (approximately $1,650,293); (e) 2018 and 2019 HOME Investment Partnership Act funds (approximately $363,600 2018 and $218,160 - 2019); (f) Low Income Housing Tax Credits under IRS Code Section 42 (approximately $9,169,056); (g) Historic Tax Credits under the IRS Code Section 47 (approximately $2,831,168); (h) Pennsylvania Redevelopment Assistance Capital Program funds as authorized under the Redevelopment Assistance section of the Capital Budget Itemization Act (approximately $2,000,000); (i) Pennsylvania Housing Finance Agency PHARE funds (approximately $1,000,000) and (j) Housing Opportunity Funds (approximately $650,000) and (k) Project Based Voucher pursuant to Section 8 of the 1937 Act; The release of the aforementioned funds will be for the purposes of developing Larimer/East Liberty Phase IV, which includes new construction of seven units and the rehabilitation of the former Larimer School into 35 units for a total of 42 mixed-income rental dwelling units. Larimer/East Liberty Phase IV will be developed along Larimer Avenue, including 540 Larimer Avenue, Maxwell Way, Stoebner Way, and Winslow Street in the Larimer neighborhood of the City of Pittsburgh, PA 15206. As part of this notice, the project requires the implementation of a set of development activities related to the completion of this project which may include, and is not limited to, demolition, acquisition, disposition, new construction, rehabilitation, stabilization, and remediation on the part of the City, URA, HACP, ARMDC, MBS and Larimer/East Liberty Phase IV, LP (the owner entity) and any other authorized parties to the project. The total projected cost of the development is $30,000,000. FINDING OF NO SIGNIFICANT IMPACT The City of Pittsburgh has determined that the project will have no significant impact on the human environment. This FONSI is based upon compliance with mitigation measures which have been identified as necessary to reduce the environmental impacts of the proposed action to a point or level where they are determined to no longer be significant. The following measure identifies the agency responsible for monitoring compliance with such. A complete explanation of all mitigation steps and schedule of implementation is available for review in the Environmental Review Record (ERR) on file at 200 Ross Street, 2nd Floor, Pittsburgh, PA 15219. Site Contamination: Implementation of the stipulations contained in the final approved Pennsylvania Land Recycling Program (Act 2) Voluntary Clean-up Plan agreed upon between HACP, the developer and the Pennsylvania Department of Environmental Protection. Mitigation measures will be monitored by the City of Pittsburgh. Based on compliance with mitigation measures which reduce the environmental impact to no longer be considered significant, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Pittsburgh certifies to HUD that William Peduto in his capacity as Mayor, City of Pittsburgh, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City, HACP and URA to use funding sources (a) through (k) identified under Request for Release of Funds above. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the City of Pittsburgh's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Pittsburgh; (b) the City of Pittsburgh has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
