LEGAL NOTICE CITY OF PITTSBURGH, ALLEGHENY COUNTY, PENNSYLVANIA SUMMARY OF A PROPOSED RESOLUTION AUTHORIZING THE INCURRENCE OF NONELECTORAL DEBT PUBLIC NOTICE is hereby given that the City Council of the City of Pittsburgh, Allegheny County (the “Local Government Unit”) will consider, at a public meeting to be held on Wednesday, February 11, 2020, at 10:00 A.M., at the Council Chamber, 5th Floor, City-County Building, 414 Grant St., Pittsburgh 15219 (or on such other date, not later than 30 days from the date of publication of this notice, and at such time and place, as the Board may lawfully determine), the adoption of a Resolution (the “Resolution”) authorizing, among other things, the incurrence of nonelectoral debt pursuant to the Local Government Unit Debt Act (the “Act”) in an aggregate principal amount estimated not to exceed $52,400,000 through the issuance and sale of its General Obligation Bonds, Series of 2020 (collectively, the “Bonds”). The proposed Resolution contains provisions setting forth, among others, the following: (a) authorization of the issuance of the Bonds in the form of nonelectoral debt to finance the undertaking of a project (the “Project”) which consists of: (i) financing the acquisition and/or construction of various capital projects within the City of Pittsburgh, including but not limited to, improvements to roads, bridges, sidewalks and other transportation projects, flood control projects, parks and recreation facilities and other facilities of the Local Government Unit (collectively the “Capital Project”), and (ii) to pay the costs of issuing and insuring, if desirable, the Bonds or any or all of the same; (b) that the Bonds will be issued as general obligation bonds; (c) covenants relating to payment and security of the Bonds; (d) provisions for the sale of the Bonds and the finding that a private sale by negotiation is in the best financial interests of the Local Government Unit; (e) the substantial form, denominations, numbers, date, maturity dates, interest rates, yields, interest payment dates, registration, payment and redemption provisions of the Bonds; (f) the creation of sinking and clearing funds; (g) authorization for the acquisition of bond insurance or other credit enhancement; (h) authorization for, and direction to, the officers of the Local Government Unit to execute certain documents and perform certain required, necessary or appropriate acts; (i) ratification and/or authorization and approval of the preliminary and final official statements; (j) covenants relating to compliance with securities laws and federal income tax laws; (k) declarations with respect to the costs of the Project and its useful life; (l) authorization for the filing with the Department of Community and Economic Development of a debt statement and such other documents as are required under the Act; and (m) repealing any conflicting provisions of other Resolutions. The full text of this proposed Resolution may be examined by any citizen at the office of the City Clerk at the City-County Building, Room 510, 414 Grant St., Pittsburgh 15219, between the hours of 8:00 A.M. and 4:00 P.M., on regular business days prior to its final enactment. This notice is given pursuant to the Sunshine Act and Section 8003 of the Act. The Council may also take action on other matters which may properly come before the meeting. NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS February 7, 2020 City of Pittsburgh-Office of Management and Budget 200 Ross Street 2nd Floor Pittsburgh, PA 15219 412-255-2211 This notice shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Pittsburgh. REQUEST FOR RELEASE OF FUNDS On or about February 24, 2020 the City of Pittsburgh will submit a request to the U.S. Department of Housing and Urban Development (HUD) to release Federal funds under Title 1 of the Housing and Community Development Act of 1974 as amended for a real estate project. The development, Givner Building is a rehabilitation of an existing non-residential building to include mixed use- and affordable housing comprised of (2) ground floor retail spaces, and (6) affordable Housing units. Four (4) of the units will be made affordable to tenants at or below 50% AMI and two (2) units at or below 80% AMI. The location of the building is 627 North Homewood Avenue in the City of Pittsburgh's Homewood neighborhood. The developer of the project is Operation Better Block, Inc. The Federal funding sources include $115,000 of 2019 HOME Funds, $165,000 of 2018 HOME Funds, $35,000 of 2019 CDBG funds, $63,000 of 2016 CDBG Funds as well as non-federal funds to include $350,000 in Pennsylvania Department of Community and Economic Development Keystone Grant Funds. The projected cost of the development is $2,319,085. FINDING OF NO SIGNIFICANT IMPACT The City of Pittsburgh has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 200 Ross Street, 2nd Floor Pittsburgh, PA 15219 and may be examined or copied weekdays from 9:00 a.m. to 5:00 p.m. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to: Whitney Finnstrom City of Pittsburgh, 200 Ross Street Pittsburgh, PA 15219 (412) 255-2211 All comments received by February 22, 2020, will be considered by the City of Pittsburgh prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The City of Pittsburgh certifies to HUD that William Peduto in his capacity as Mayor, City of Pittsburgh, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Urban Redevelopment Authority to use development funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Pittsburgh certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Pittsburgh; (b) the City of Pittsburgh has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
