NOTICE OF AN INTENT TO REMEDIATE TO AN ENVIRONMENTAL STANDARD FORMER KOPPERS CLAIRTON TAR FACILITY Key Environmental, Inc. (KEY) on behalf of State Street, Limited Liability Company (LLC), submits this Newspaper Notice of an Intent to Remediate to an Environmental Standard. (Sections 302(e)(1)(ii), 303(h) (1)(ii),304(n)(1)(i), and 305(c)(1)) pursuant to the Land Recycling and Environmental Remediation Standards Act, the act of May 19, 1995, P.L. 4, No. 1995-2., notice is hereby given that State Street, LLC has submitted to the Pennsylvania Department of Environmental Protection a Notice of Intent to Remediate a site located at 300 N State Street, Clairton, PA 15025 (Clairton City Municipality, Allegheny County). This Notice of Intent to Remediate states that the site was historically used for processing of coal tar generated at the United States Steel Clairton Coke Works and other similar coking plants. Historical chemical industrial area contamination exists. The primary contaminants associated with coal tar plants are typically Polycyclic Aromatic Hydrocarbons. This class of chemicals is expected to be the primary contaminant class to be addressed. The potential for the presence of benzene, toluene, ethylbenzene, and xylenes also exists based on the proximity of the facility to the United States Steel light oil plant. The possible presence of elevated concentrations of volatile organic compounds possibly associated with equipment maintenance, heavy metals occasionally associated with coal and coke operations, and PCBs historically associated with industrial electrical transformers, if evidence suggests their past presence, will also be examined and remediated, if present. State Street, LLC has indicated that the proposed remediation measures will consist of surface soil sampling and analysis to delineate the extent of impacts at the site. Impacted areas will be addressed via the use of an engineering control consisting of an asphaltic concrete cover with appropriate stormwater management features. An institutional control in the form of a Uniform Environmental Covenant will be prepared and filed for the site. The proposed future use of the property will be non-residential for use as a parking lot for United States Steel Clairton Coke Works. For bids $200,000.00 or over, bids must be accompanied by a bid bond in the amount of ten percent (10%) of the bid for the project under consideration. Said bond shall be duly and legally executed with a surety or trust company which has complied with city ordina- nces/resolutions relating thereto. Wages paid on this project shall not be less than the minimum wages determined by the U.S. Department of Labor as set forth in the contract documents. The contractor will be required to comply with all applicable Equal Employment Opportunity requirements for Federally Assisted construction contracts. The contractor must assure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin. Attention is called to Executive Order 11246, to Section 3 of the Housing and Urban Development Act of 1968, 12 U.S.C. 1701U, and to the Section 3 Clause and Regulations set forth in 24 CFR, Part 135. The Contractor will be required to comply with the following laws, rules and regulations: All provisions of US Executive Order 11246 of September 24, 1965, as amended by US Executive Order 11375 and as supplemented in US Department of Labor Regulations (41 CFR, Part 60), and of the rules, regulations, and relevant orders of the US Secretary of Labor. Contractor shall comply with all applicable standards, orders, or requirements issued of the Clean Air Act (42 USC 1857 et. seq.), Section 508 of the Clean Water Act (33 USC 1368), Executive Order 11738, and Environmental Protection Agency regulations (40 CFR, Part 15). Contractor shall comply with the Davis-Bacon Act the Davis-Bacon Act (40 U.S.C. 276a to 276a-7) as supplemented by Department of Labor regulations (29 CFR part 5). Procedures for compliance's to these acts shall be as follows: All specifications for construction contracts and subcontracts will contain the prevailing wage rates (as enclosed in this bid package) as determined by the Secretary of Labor in accordance with the Davis-Bacon Act, as amended (40 U.S.C. 276-a to 276-C-5) and provision that overtime compensation will be paid in accordance with the Contract Work Hours and Safety Standards Act Regulations (29 CFR, Parts 5 and 1926). The contract provisions shall require that these standards be met. Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity (Executive Order 11246): Bidder's attention is called to the “Equal Opportunity Clause” and the “Standard Federal Equal Employment Specifications” set forth in 41 CFR Public Contracts and Property Management Part 60-4.3 Equal Opportunity Clauses.
